FRAMEWORK PLATFORM
I hereby give my prior, free, express and informed consent to be a user of the MARCO platform (“MARCO”) owned by Deep Talk SpA (the “Provider”), which aims to develop a solution for conversational modeling of scientific data related to prostate cancer and other pathologies, aimed at health professionals
I also give my consent for the Provider to process my personal data that I can voluntarily provide to the Provider as a MARCO user, in the terms described below. I have been informed and consent that:
My personal data will be processed by the Provider for the purpose of providing me with and managing my access to the MARCO platform as well as to the features and services related to MARCO.
That MARCO is a conversational artificial intelligence platform on medical topics and that the Provider may process information of a medical nature that you consult as a MARCO user (the “Consulted Data”).
That different companies are involved in the financial development of the MARCO platform. In this context, the Consulted Data may be transferred and/or transferred and/or shared with the companies with which Deep Talk works. The Consulted Data will be treated by Deep Talk in accordance with its Privacy Policy available here: https://www.marco.care/politicas-de-privacidad.
That the Consulted Data may be transferred and/or transferred and/or shared with companies associated with Marco, as long as the Consulted Data is transferred in such a way that my identity cannot be recognizable or associated with the Consulted Data.
That because Marco's partner companies will not process or receive my personal data, I declare that under no circumstances will I have the right to seek compensation for the misuse of my personal data to these companies or to blame them for any type of violation by the Provider of the Personal Data Protection Act No. 25,326, its Regulatory Decree No. 1558/01 and with the Resolutions and Provisions of the Data Protection Authority.
The Consulted Data may be transferred outside of Argentina, to jurisdictions that may provide a lower level of personal data protection than that existing in Argentina, a circumstance that I understand and consent to by signing this consent form. The personal data that I must provide to MARCO are stipulated in the Privacy Policy https://www.marco.care/politicas-de-privacidad and they are the minimum necessary for us to deliver an excellent service.
If I do not provide this data or provide incorrect data, my access to MARCO may be suspended and/or interrupted, without the right to claim any compensation in my favor. The Provider may keep my personal data for an additional period of three (3) years.
The personal data you provide will be included in a database that will be under the responsibility of Deep Talk SpA with address in Holland 895, Providencia, Santiago de Chile. As responsible for the database, the Provider guarantees that its internal processes comply with the legal obligations of security and confidentiality imposed by Law 25,326 and its Regulatory Decree No. 1558/01.
As the owner of my personal data, the Provider assures me that I exercise the right to access them free of charge at intervals of not less than six (6) months, unless a legitimate interest is established for this purpose as established in article 14 paragraph 3 of Law 25,326, and to request the updating, deletion or rectification of my personal data, in accordance with Article 16 of Law 25,326. The Agency for Access to Public Information, the supervisory body of Law 25,326, has the power to deal with complaints and complaints that arise in relation to non-compliance with the regulations on the protection of personal data. I declare and guarantee that I am a health professional with valid registration in the country where I practice the profession and that my use of MARCO, the Consulted Data and/or any type of information consulted and/or provided in MARCO, (i) will be free; (ii) will be based on involving information related to my profession and specialty; (iii) is not conditioned on me recommending, prescribing, acquiring and/or promoting any type of product; (iv) it is permitted by laws, codes, and/or internal regulations that may apply to me by virtue of the position I currently hold, whether in the private and/or public sector; (v) it will not in any way cause me a conflict of interest in the performance of my professional functions.
The information provided in MARCO cannot be considered as professional advice, diagnosis, treatment and/or a professional medical recommendation. I declare and guarantee that I know how MARCO works and understand that artificial intelligence platforms may have flaws, including the possibility of providing inaccurate or incorrect information. Neither the Consulted Data nor any type of information consulted and/or provided in MARCO can be considered as professional advice, diagnosis, treatment and/or a professional medical recommendation.
I will practice the profession under my medical judgment, in accordance with the legal framework applicable to the practice of medicine and guaranteeing confidentiality and respect for patients' rights in their relationship with health professionals and health institutions. Consequently, the Provider and associated companies will not have any responsibility derived from or related to the decisions you make as a health professional, regardless of your use of MARCO and/or the Data Consulted. The Provider will have no responsibility related to the decisions you make as a health professional.
I undertake to hold harmless and compensate the Provider against any claim derived from the acts I perform in the context of the exercise of my profession and for any breach or alleged breach of the applicable regulations attributed to me. Access to MARCO is not granted in exchange for any type of consideration and is not an undue benefit. I may receive invitations to respond to surveys or other communications aligned with the applicable regulatory framework.
I DECLARE THAT I UNDERSTAND AND ACCEPT ALL THE TERMS OF THIS FORM OF THESE TERMS AND CONDITIONS AND I GIVE MY PRIOR, FREE, EXPRESS AND INFORMED CONSENT FOR THE PROCESSING OF MY PERSONAL DATA.
